GENERAL CONDITIONS FOR ROOM BOOKINGS

1. SCOPE OF APPLICATION

These General Terms and Conditions for the Reservation of Rooms apply to the Hotel La Palma au Lac of MIRGA AG based in Zug for the provision of hotel rooms for the accommodation of guests.
The customer's general terms and conditions do not apply.
 

2. CONCLUSION OF CONTRACT

A credit card is always required as a guarantee for an individual reservation.
The following cards are valid as a guarantee for a room reservation
- Credit card (Visa, American Express, Diners Card, Mastercard, JCB, CUP).
- Prepayment for the entire duration of the stay, e.g. by bank transfer or credit card.
- Written guarantee by credit card from a registered company based in Switzerland.

An offer for group bookings (4 rooms or more) is expressly labelled as such and must be signed and returned to the hotel by the customer. An offer is generally valid for 10 days, but is not binding on the hotel. In particular, this means that offers are never binding and no rooms or places can be optioned.
 

3. SERVICES AND PRICES

The customer is not entitled to the provision of specific rooms, but the hotel undertakes to keep rooms of the booked category available. If, for unforeseeable reasons, no equivalent room is available on arrival, accommodation will be provided in a room of the next higher category. If no room is available in the hotel, the hotel will organise at least equivalent accommodation in another hotel.
The customer is obliged to pay the hotel's applicable or agreed prices for the provision of the room and the other services utilised by the customer. This also applies to services and expenses of the hotel to third parties arranged by the customer.
The prices are in CHF, per room/night, including free Wi-Fi, service and VAT. The tourist tax per person/night is not included.
L'hotel La Palma au Lac uses yield management technology to manage the hotel prices. Hotel rates therefore vary according to availability, length of stay, number of rooms booked, season and payment and cancellation conditions.
 

4. HANDOVER AND RETURN OF THE ROOM

The booked rooms are available to the customer from 3 pm on the agreed day of arrival. The customer does not have the right to move into the room earlier, but can ask at reception any time whether an earlier check-in is possible.
On the agreed day of departure, the rooms must be left and made available to the hotel by 11 am at the latest. After this time, the hotel may charge 50% of the total accommodation price (daily rate) if the room is vacated late up to 5 pm and 100% after 5 pm.


5. PAYMENT

Payment for individual bookings must be made on the day of departure at the latest. For company or group bookings, invoices can be sent for the remaining amount. Hotel invoices without a due date must be paid in full within 10 days of receipt of the invoice. The hotel is entitled to declare accrued receivables overdue at any time and to demand immediate payment.
The hotel is entitled to demand an appropriate advance payment or security deposit upon conclusion of the contract. The amount of the advance payment and the payment dates will be communicated with the offer. The hotel reserves the right to debit the full invoice amount from the guarantee credit card after expiry of the free cancellation periods. Any exchange rate differences or bank charges shall be borne by the customer.


6. CANCELLATION TERMS

6.1 Cancellation conditions for individual bookings

Individual bookings are generally considered final as soon as the offer has been signed or expressly confirmed by the customer. In the event of cancellation at short notice after the cancellation deadline, 100% of the accommodation amount will be charged.
However, some rates are subject to special conditions that no longer permit cancellation (non-refundable). Unless otherwise stated, the following conditions apply to individual bookings:
- Cancellation up to 48 hours before arrival (until 3 pm): free of charge.
- Cancellation from 48 hours before arrival: 100% of the stay

For certain periods of the year (film festival or Moon&Stars) the cancellation conditions may be more restrictive.
When confirming your reservation, you will be asked to provide your credit card details to guarantee your stay. In the event of a non-refundable offer, 100% of the stay will be charged. Your reservation is not finalised until you have received confirmation from reception. Please make sure that you have entered your credit card number and expiry date correctly. If these details are not valid, the reservation will not be accepted, subject to notification by reception. Make sure that the expiry date of the credit card is after the departure date. For reservations at flexible rates, the credit card will be charged as soon as the reservation can no longer be cancelled. Extras used during the stay will be paid directly at the hotel on the day of departure.

PLEASE NOTE: The confirmation and cancellation conditions may vary depending on the offer booked. Any confirmation and cancellation conditions that differ from the standard conditions mentioned above will be indicated at the time of booking.

In the event of a no-show, the full amount will be debited from the card previously communicated.


6.2 Cancellation policy for groups

The cancellation conditions for group bookings are regulated separately. If there are no separate cancellation conditions, the following rules apply:
A deposit of 50% of the total amount of the stay and a company credit card are required at the time of booking to guarantee the reservation.
A company credit card is required to guarantee the reservation.
Cancellations within 90 days prior to check-in: no cancellation fee and refund of deposit/premium.
- Cancellations received from the 89th day and within 60 days prior to check-in: 50% of the total stay for the cancelled rooms and/or nights.
- Cancellations received from the 59th day before and within 30 days before check-in: 75% of the total stay for the cancelled room and/or nights.
- After the 30th day before check-in, you must pay the cost of your stay or pre-authorise the balance of your stay on the credit card provided at the time of booking.
- After this deadline and until check-in or no-show: 100% of the total price for the entire stay of the cancelled rooms/nights.


7. BOOKINGS VIA TOUR OPERATORS

For bookings made via a tour operator, the general terms and conditions of the tour operator apply.


8. CHILDREN'S PRICES

On request, a baby cot can be provided free of charge. Children up to the age of 6 stay free of charge. From 6 to 12 years of age, children stay in an extra bed for a surcharge of CHF 30 per night. From the age of 12, the surcharge for the extra bed is CHF 70 per night.


9. LIABILITY / DUTY OF CARE

The hotel room is to be used by the customer with the greatest possible care. The customer or the company is obliged to pay for any damage caused. The hotel accepts no liability for theft etc. and in connection with third-party services. Furthermore, the hotel shall only be liable for direct, contractual or non-contractual damage caused by wilful intent or gross negligence. Any further liability is excluded.

12. FINAL PROVISIONS

In addition to the general cancellation and sales conditions, other provisions and booking conditions may apply and take precedence. Amendments or additions to the accepted offer or these general terms and conditions must be made in writing. Unilateral amendments or additions by the customer are invalid.
Should individual provisions of these General Terms and Conditions be invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.


GENERAL TERMS AND CONDITIONS FOR EVENTS (F&B, MICE)

1. SCOPE OF APPLICATION

These General Terms and Conditions for Events apply to the rental of rooms for seminars, banquets and events as well as to other related services or deliveries in favour of the customer or organiser. The subletting or re-letting of the rooms or areas provided as well as invitations to lectures, sales or similar events require the prior written consent of the hotel.
The General Terms and Conditions of the organiser shall not apply.


2. RESERVATIONS

A room rental offer is expressly labelled as such and must be signed by the customer and returned to the hotel. An offer is valid for 7 days (acceptance period). Offers, price lists and the like of the hotel do not constitute a binding offer, nor does a temporary reservation of rooms, unless the hotel has expressly agreed to this.


3. PRICES

Prices are subject to change without notice. All prices are quoted in Swiss francs, strictly net, including service and statutory VAT. The prices confirmed in writing by the hotel apply.


4. PAYMENT

Hotel invoices that are not yet due must be paid in full within 10 days of receipt. The hotel is entitled to declare accrued claims due at any time and to demand immediate payment. The hotel is entitled to demand an appropriate advance payment or security deposit upon conclusion of the contract or thereafter. The amount of the advance payment and the payment dates shall be announced with the offer. If no separate advance payment conditions exist, the following provisions shall apply:
If the organiser is domiciled abroad, the hotel reserves the right to charge the full invoice amount to the guarantee credit card or to demand full payment prior to the event. Any exchange rate differences or bank charges shall be borne by the organiser.


5. JOINT AND SEVERAL LIABILITY FOR PAYMENT

If the customer is not also the organiser, he shall be jointly and severally liable with the organiser for the entire invoice amount. This liability shall also apply if direct payment has been expressly agreed.


6. CANCELLATION TERMS

Cancellations will only be accepted in writing. The hotel reserves the right to adapt the cancellation conditions individually depending on the type and scope of the event and to include them in the offer/reservation confirmation.
If there are no separate cancellation conditions, the following cancellation rules apply:
up to 61 days before the event CHF 100.00 processing fee
60 to 31 days before the event 25% of the agreed service
from 30 to 8 days before the event 50% of the agreed service
from 7 days before the event 100% of the agreed service
Any preparatory work already carried out as well as materials, equipment and accessories ordered or specially produced will be charged in full in all cases.
If the actual number of participants on the day of the event is lower, the final confirmed number will be used as the basis for invoicing. Additional costs arising from additional participants will be invoiced. Exceeding the maximum capacity of the hall as stipulated by the fire police is not permitted.


9. DETAILED INFORMATION / PROCEDURE

For detailed organisation it is necessary to arrange a date in advance. In order to ensure that the event runs smoothly, all important details (e.g. equipment, choice of menu, timetable, show interludes, etc.) must be communicated to the hotel at least 10 days before the event. Agreed programme times must be strictly adhered to by both parties.


10. USE OF THE ROOMS

In justified exceptional cases, the hotel is authorised to change rooms for events at the last minute. In any case, the hotel reserves the right to provide a room appropriate to the number of participants and the event if the number of persons is reduced. Outside the rented rooms, reception tables, advertising material, banners etc. may only be set up after consultation with the hotel. Public areas of the hotel may not be used for group work. These must be carried out in the agreed group rooms. Smoking is prohibited in all indoor areas of the hotel.


11. MENU CHANGES

The hotel reserves the right to change the menu and wines after notifying the customer.


12. FOOD AND DRINKS BROUGHT IN FROM OUTSIDE

The organiser and its guests may not bring their own food and drinks to events. Exceptions require a written agreement with the hotel. If the organiser brings their own wines, spirits, cakes etc., an agreed service charge will be levied in addition to the service charge to cover general expenses.


13. DECORATIONS / FLOWERS

The installation of decorations or other objects is subject to authorisation, also for reasons of fire safety. Any damage caused during preparation etc. shall be borne by the organiser.


14. PARKING SPACE

Parking spaces are usually available in or near the hotel. Unless otherwise agreed, parking costs are to be borne by the organiser or the individual participants.


15. TECHNICAL EQUIPMENT AND CONNECTIONS

If the hotel acquires technical and other equipment from third parties at the request of the organiser, it shall act in the name of, on the authority of and for the account of the organiser, who shall reimburse the organiser for this equipment. The organiser shall be liable for the careful handling and proper return of the equipment. The organiser shall indemnify the hotel against all third-party claims arising from the provision of these items.
The use of the organiser's own electrical equipment using the hotel's electricity network requires the hotel's written consent. Failures or damage to the hotel's technical equipment caused by the use of this equipment shall be borne by the organiser, unless the hotel is not responsible for this. The hotel may record the electricity costs arising from the use of the equipment and charge a flat rate.
With the hotel's consent, the organiser may use its own telephone, fax and data transmission equipment. The hotel may charge a connection fee.
If the corresponding hotel facilities remain unused due to the connection of the organiser's equipment, a cancellation fee may be charged.
Faults in the technical or other facilities provided by the hotel will be rectified immediately if possible. Payments may not be withheld or reduced insofar as the hotel is not responsible for these disruptions.
By arrangement with the hotel, a conference technician can be provided to assist during the event. Smaller jobs can be carried out by the hotel at any time on request. For larger congresses with video/sound/microphone support, the organiser is recommended to call in an external technician for support. No cost reduction is possible in the event of technical faults or defects.


16. FIRE SAFETY REGULATIONS

The organiser undertakes to comply with the hotel's fire safety regulations, in particular to keep the escape routes clear and to ensure that the material brought along complies with the fire safety regulations. The use of flammable objects is strictly prohibited.


17. DELIVERY AND COLLECTION OF MATERIALS

Deliveries and collections for events must be agreed with the hotel and the hotel must be notified in writing in good time, at least prior to arrival. The hotel reserves the right to refuse deliveries without valid sender or recipient details and event details. Any obligation or liability on the part of the hotel is rejected. As the hotel's storage space is limited, the hotel may refuse to accept material before the day of the event.
For shipments from abroad to Switzerland, customs duties and VAT must always be paid in addition to the shipping costs. If the forwarding agent is unable to provide exact costs on delivery, we reserve the right to charge the organiser a flat rate of CHF 100.00.


18. MUSICAL ENTERTAINMENT, CLOSING TIME AND NIGHT SURCHARGE

For events with music, please note that music is only permitted at room volume after
11 pm. DJs and bands are obliged to keep the volume down. The maximum playing time is until midnight. For outdoor music performances with a loudspeaker system, a licence must be obtained from the city police at least 4 months before the event. Failure to comply with the regulations will result in additional costs for the organiser. The fee for licence fees in connection with music performances must be clarified by the organiser and will be charged to the organiser.
If an event extends beyond the legally permitted police hours, a night surcharge must be paid. The extended opening hours must be notified to the hotel at least 1 month before the event. The required police permit will be obtained by the hotel and charged to the organiser.
From 11 pm, windows and doors must be kept closed and the volume of the music reduced. Guests staying outside are requested to keep quiet. The instructions of the hotel staff must be followed. The organiser is responsible for complaints and possible fines.


19. GUEST ROOMS

For events with overnight accommodation, the hotel must receive a room list from the organiser at least 14 days before the arrival of the guests with the following details of the individual guests: First and last names / arrival and departure dates / date of birth of the guests / terms of payment.
In the case of contingent bookings without a room list from the organiser, the hotel rooms must be booked directly by the guests and individually guaranteed with a valid credit card.
The cancellation conditions for individual cancellations up to a maximum of 4 rooms apply, thereafter the cancellation conditions of the group apply. After expiry of the deadline set by the hotel, the rooms still available in the respective contingent will be offered for sale. The organiser is in any case liable for the unpaid costs of the rooms booked by its guests and their consumption (no-shows, minibars, etc.).


20. RESPONSIBILITY / DUTY OF CARE

The premises and materials provided are to be used by the guest with the greatest possible care. The organiser is liable for all damage and loss. The hotel accepts no liability for theft, damage or services provided by third parties. This also applies to personal injury, insofar as this was not caused by employees of the hotel. The hotel is liable within the scope of the statutory provisions.


21. DATA PROTECTION

The Hotel La Palma au Lac is authorised to collect and store the necessary personal customer data and to process it in compliance with the duty of care in the sensitive handling of customer data.


22. FINAL PROVISIONS

In addition to the General Terms and Conditions for Events, other provisions and booking conditions may apply which take precedence over these terms and conditions. Amendments or additions to the accepted offer or these General Terms and Conditions must be made in writing. Unilateral amendments or additions by the organiser are invalid.
The place of fulfilment and payment is the registered office of the hotel.
Swiss law shall apply with Zug as the exclusive place of jurisdiction.
Should individual provisions of these GTC be invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
